Whereas these rescheduled amounts have likewise not been paid;
Whereas al1 attempts to obtain payment failed, including a request by
Africom-Zaire addressed to the President of the Republic of the Congo under
cover of letter No. AFCIIN1017187;
Whereas the Democratic Republic of the Congo thus remains in debt to
Mr. Diallo. on account of outstanding instalment paymeiits, in a total amount
of Z 207,082,872.70 (1987 value);
( 2 ) Investment in a container ship
Whereas, with a view to increasing the capacity of his company Africacontainers,
in 1986 Mr. Diallo initiated a project for the acquisition of a container
ship capable of carrying up to 56 containers;
Whereas it was intended that this vessel should operate between Kinshasa
and Ilebo, carrying on the outward journey lubricating products for the local
oil companies and on the return journey copper ore for Gécamines;
Whereas the investment for this extension and diversification of Africacontainers'
operations amounted to a total of Z 528,086,000, and was approved
by the Congolese State by Interdepartmental Decree No. CABIPLAN10144
of 3 1 December 1987 ;
Whereas Article 5 of that Decree provides that the Congolese State guarantees
to foreign investors the right to export their earnings, and compensation in
the event of expropriation;
Whereas the project was to be financed in the following manner:
- loan from Sofide: Z 316,852,000 (1987 value);
- contribution from Africacontainers' own resources: Z211,234,000 (1985
value) ;
Whereas, when Africacontainers was unable to provide the full amount of its
contribution, Sofide made it a condition of the release of its share of the investment
funds that the Congolese State should draw up a schedule for the payment
of its arrears of debt to Africacontainers;
Whereas in this way Mr. Diallo succeeded in obtaining from the State an
undertaking to settle its debts to Africacontainers in five instalments running
from 13 January 1988 to 13 April 1998;
Whereas this undertaking, signed by the Secretary of State for Finance
[Commissaire d'Etat Délégué aux Finances], was never honoured;
Whereas this arbitrary and vexatious conduct on the part of the Congolese
State prevented Mr. Diallo from obtaining possession of what was rightfully
his and seriously damaged his business by causing the investment project for
the container vessel to fail;
Whereas, as a mark of their indignation at this legalliinancial scandal, the
Congolese executives of Africacontainers prepared an estimate of the earnings
that the company would have achieved between 1990 and 1998 if the project
had succeeded ;
Whereas this document, based on the Congolese investment code, evaluates
the loss of earnings suffered by Mr. Diallo at a total amount of
US$12,322,052,951.15;
